Welcome to Y&O Elite Clinic. These Terms and Conditions govern your access to our website and your use of our medical concierge, referral, care-coordination, and travel-support services.
By accessing our website, submitting an inquiry, or using our services, you acknowledge that you have read and agree to these Terms. If you do not agree, you should not use our website or services.
1. Administrative Role Only
Our services are administrative only, are not emergency services, and are not a substitute for professional medical advice, diagnosis, or treatment. Y&O Elite Clinic is an independent medical concierge and referral service only. We facilitate introductions, communications, scheduling, and travel-related support between prospective patients and independent healthcare providers in Bangkok. We do not provide medical advice, diagnosis, treatment, nursing care, or any other healthcare service.
2. No Medical Provider Role or Liability
Y&O Elite Clinic is not a hospital, clinic, or medical provider and does not employ or control the physicians, surgeons, nurses, hospitals, or clinics involved in your care. No Medical Responsibility: to the maximum extent permitted by applicable law, Y&O Elite Clinic shall not be responsible or liable for any consultation, diagnosis, procedure, treatment, aftercare, medical outcome, complication, or other healthcare service provided by any third party. No Doctor-Patient Relationship: your use of our services does not create any doctor-patient, patient-provider, fiduciary, or similar relationship with Y&O Elite Clinic. Any medical relationship, informed-consent process, and duty of care exists solely between you and the treating provider.
3. Independent Healthcare Providers
Any medical procedure or aesthetic treatment is performed solely by independent, licensed third-party providers. Y&O Elite Clinic does not supervise or control their clinical decisions, medical protocols, or care delivery, and no such provider acts as our employee, agent, or representative by reason of our referral or coordination services.
4. Assumption of Risk and Disclaimer of Warranties
Medical and aesthetic procedures involve risks, uncertainties, and outcomes that vary from person to person. By using our services, you acknowledge that any decision to proceed with treatment is made at your own risk, based on your own judgment and the advice of your treating provider. To the maximum extent permitted by applicable law, Y&O Elite Clinic disclaims all representations and warranties, express or implied, regarding provider availability, suitability, treatment plans, outcomes, recovery periods, aesthetic results, or quality of care, including any information presented on our website.
5. Privacy and Cross-Border Data Transfers
To coordinate appointments and related services, Y&O Elite Clinic may collect, use, and transmit your personal and sensitive health information, including images and medical history, to healthcare providers and relevant service partners in Thailand and other relevant jurisdictions. By using our services and submitting such information, you consent to that collection, use, and cross-border transfer for coordination and related administrative purposes.
6. Third-Party Travel and Logistical Services
Any assistance with flights, hotels, transportation, translation, payments, or other ancillary services is provided solely for convenience. Y&O Elite Clinic does not own, operate, or control those third-party providers and shall not be liable for their acts, omissions, delays, cancellations, service failures, or insolvency.
7. Limitation of Liability and Liability Cap
Please read this section carefully as it limits your ability to recover damages. To the maximum extent permitted by applicable law, Y&O Elite Clinic and its owners, directors, employees, contractors, and affiliates shall not be liable, whether in contract, tort, negligence, strict liability, or otherwise, for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of income, opportunity, travel expense, or reputational harm, arising out of or relating to the website, our services, any medical treatment, any travel arrangement, or any act or omission of a third party. If, notwithstanding the foregoing, Y&O Elite Clinic is held liable for any claim arising out of or relating to its concierge or referral services, its total aggregate liability shall not exceed the administrative or concierge fees actually paid directly to Y&O Elite Clinic for the specific service giving rise to the claim. Medical, hospital, travel, lodging, and other third-party charges are excluded from this cap. To the maximum extent permitted by applicable law, you agree not to seek or recover from Y&O Elite Clinic any amount exceeding the liability cap set out above.
8. Indemnification
You agree to indemnify, defend, and hold harmless Y&O Elite Clinic and its owners, directors, employees, contractors, and affiliates from and against any third-party claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or relating to your breach of these Terms, the information you submit, your travel, or any dispute between you and a healthcare provider or other third party.
9. Governing Law and Exclusive Jurisdiction
These Terms and any dispute, claim, or controversy arising out of or relating to the website or our services shall be governed by and construed in accordance with the laws of Thailand, excluding its conflict-of-laws rules. Subject to applicable mandatory law, the competent courts located in Bangkok, Thailand shall have exclusive jurisdiction over any legal proceeding arising out of or relating to these Terms, the website, or our services, and you waive any objection based on venue or forum non conveniens.
10. Changes to These Terms
We may update these Terms from time to time by posting the revised version on the website. Unless a later effective date is stated, any changes will take effect upon posting.
